The tenancy is terminated effective October 31, 2021. The Tenant must move out by that date and pay the Landlord compensation for use of the unit. If the Tenant does not pay the full amount owing by October 3, 2021, the Tenant will start to owe interest. If the unit is not vacated by October 31, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation by the Landlord's child.
The Tenant requested a much longer period to find alternate accommodation, until spring 2022, due to difficulty finding similar two-bedroom accommodation at his current rent of $1,300 per month.
The Tenant testified that he had reason to believe the living arrangements within the Smith family were fine, and questioned why Jacob would move out.
