The Landlord shall pay the Tenant $3,159.53, which includes a rent abatement of $694.84 for the period the Tenant was illegally locked out of the unit, and $2,464.69 for the Tenant's reasonable out-of-pocket expenses. If the Landlord does not pay the full amount by January 23, 2022, the Tenant will be owed simple interest at 2.00% annually on the outstanding balance.
Tenant applied for an order determining that Landlord harassed, obstructed, coerced, threatened or interfered with the Tenant, entered the rental unit illegally, altered the locking system on a door giving entry to the rental unit or residential complex without giving the Tenant replacement keys and substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of the Tenant's household.
Landlord argued that the unit was move-in ready and the Tenant could have continued moving in despite the lack of professional painting and cleaning.
Landlord's agent, the Property Manager, entered the unit without the Tenant's permission and changed the locks, preventing the Tenant from accessing the unit.
