The tenancy is terminated effective September 30, 2018. The Landlords shall pay the Tenant $1,050 as an abatement of rent and $300 for moving costs, for a total of $1,350. If the Landlords do not pay the full amount by August 12, 2018, they will owe interest at 3% annually on the outstanding balance.
Tenant applied for an order determining that Landlords failed to meet their maintenance obligations or comply with health, safety, housing or maintenance standards, and that the Landlords or their superintendent or agent substantially interfered with the Tenant's reasonable enjoyment of the rental unit or residential complex due to second-hand marijuana smoke infiltrating the Tenant's unit.
Landlord communicated with the tenant in the lower unit and told the Tenant that if he was not happy, he should move.
Tenant attempted to seal his unit with tape and tarpaulins to block the second-hand smoke, and called the police and the Landlord to address the issue.
