The Landlord's application to terminate the tenancy and evict the Tenant is granted. The tenancy is terminated and the Tenant must move out by December 31, 2025. The Landlord proved the purchaser requires the unit in good faith for personal residential occupation. The Tenant is granted an extended eviction date to December 31, 2025 due to the challenges in finding alternative housing.
Tenant has lived at the rental unit for approximately 10 years, has difficulty finding comparable housing in the area, and has medical issues and financial circumstances that make it challenging to secure new housing quickly.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser in good faith requires possession of the rental unit for the purpose of residential occupation.
Tenant argued the N12 notice was a ruse to have the Tenant evicted and the sale was effectively a sham due to outstanding bylaw enforcement issues related to maintenance.
Tenant testified that he does not believe the new landlord, the purchaser, wants to move into the rental unit in good faith and that the reason for the sale was outstanding maintenance issues that were never addressed.
