The Landlord has proven the grounds for termination of the tenancy and the claim for compensation. The tenancy will terminate on July 31, 2024. The Tenant must move out by that date, and if not, the Landlord may file the order with the Court Enforcement Office for eviction. The Tenant shall pay $50.20 per day for compensation for the use of the unit starting June 1, 2024, to the date the Tenant moves out, less the last month's rent deposit and interest owing.
The Tenant is a single father with a 16 year old daughter who lives with him and attends high school near the rental unit. The Tenant's workplace is also near the rental unit. The Landlord's current living situation is not ideal, but he does have somewhere to live.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
The Tenant asks that the application be dismissed as he feels the N12 notice was given in bad faith and the real underlying motive is that the Landlord wants to charge more rent.
The Tenant believes the Landlord gave the N12 notice in bad faith because he wants to re-rent the unit for a higher rent. The Tenant also believes the Landlord gave the N12 notice in bad faith because this is the second N12 notice given to him.
