The Tenant proved the allegations in the application on a balance of probabilities. The Landlords must pay the Tenant $1,050.00 in illegally retained rent, $2,025.00 in unpaid N12 compensation, $200.00 in refundable key deposit, $25.31 interest on rent deposit, and the filing fee of $48.00, for a total of $3,348.31.
Tenant applied for an order determining that the Landlords collected or retained money illegally. The Tenant alleged the Landlords charged an illegal rent increase, failed to pay interest on the rent deposit, and did not return the key deposit when the Tenant vacated.
Landlords disputed the Tenant's claim for interest on the voluntarily pre-paid rent.
