The Landlord's application is granted. The tenancy is terminated, and the Tenant must move out by June 30, 2024. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office for enforcement. The Landlord must apply the last month's rent deposit to the last month of the tenancy and pay any outstanding interest.
Tenant has lived in the unit since 2004, has an adult child with autism, and her 15-year-old daughter goes to school in the area. Delaying the eviction will allow the Tenant's daughter to finish the school year.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord recently inherited the rental property and wants to move into the unit because he is separating from his wife and needs his own place to live. The Landlord's daughter goes to school near the rental unit and there is a synagogue within walking distance.
Tenant argued that the Landlord did not pay the required compensation by the termination date in the N12 notice.
Tenant has lived in the rental unit since 2004 and has an adult child with autism. The Tenant's 15-year-old daughter goes to school in the area.
