Application Date (Estimate)

Hearing Date
Jul 2024
Order Date
Jul 22, 2024
Tenancy End Date
Aug 2024
We estimate Application Date using rent arrears.
Unless the Tenant voids the order by paying $18,186 by August 1, 2024 or $21,186 by August 2, 2024, the tenancy will be terminated. If the Tenant does not void the order, they must pay the Landlord $13,100.59 and vacate the unit by August 2, 2024. The Landlord is entitled to compensation of $98.63 per day for use of the unit starting July 12, 2024 until the Tenant vacates.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
Landlord submitted that the Tenant had ignored any and all other communications regarding the negotiation of a repayment plan prior to this hearing, and that it is only now that the Tenant is interested in a payment plan.
Tenant testified they wanted to preserve the tenancy and was willing to enter into a payment plan of $1,515.50/month. Tenant stated they had just been hired in a position paying $82,000/year but did not provide any supporting documents.
