The Tenant's application is dismissed as the Tenant failed to prove their case on a balance of probabilities. The evidence did not establish the existence of mold, significant floor buckling, or structural damage to the cabinets.
Tenants applied for an order determining that the Landlord collected or retained money illegally and failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006. The issues included water damage to the laminate flooring, kitchen sink and vanity cabinet.
Landlord attended the rental unit within 45 minutes of the December 2022 flooding event and used a wet/dry vacuum to remove the water from the floor surface.
Tenants reported flooding events in October 2021 and December 2022. Tenants used bleach and ammonia-based cleaners to clean the floors after the flooding.
