The Landlord has proven the grounds for termination of the tenancy. The eviction is postponed to October 31, 2024 to allow the Tenant time to find alternate accommodations due to the Tenant's restrictions and impairments related to mental health and addiction.

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord testified he defaulted paying his mortgage payments three times on his principle residence since his mortgage renewed in January 2024. He also testified his current property was in foreclosure in July 2023 and he borrowed funds to stop the bank from seizing the property. He has no employment income as he's retired and wants to occupy the Tenant's unit permanently.
