The Landlord has proven the grounds for termination of the tenancy. The tenancy is terminated and the Tenant must move out by November 12, 2024. The Landlord has complied with the requirement to provide one month's rent compensation to the Tenant by waiving the October 2024 rent. The Tenant does not seek any eviction relief.
Landlord applied for an order to terminate the tenancy and evict Tenant due to the need for vacant possession to complete extensive repairs and renovations to the rental unit and the residential complex. The Landlord served a valid N13 Notice of Termination with a termination date of June 30, 2024.
Landlord obtained building permit #23-143642 on January 30, 2024 to complete extensive renovations to create a second rental unit in the basement.
Tenant believes the Landlord's application is not made in good faith due to various tenancy issues.
Tenant plans to vacate the unit on October 31, 2024.
