The tenancy is terminated, and the Tenant must move out by January 15, 2025. The Landlord is required to provide the Tenant with three months' rent compensation, which the Tenant has not yet cashed. The Tenant has the right to move back into the unit once the renovations are completed.
Tenant is a student with limited financial resources, and a temporary move would be costly and disruptive.
Landlord applied for an order to terminate the tenancy and evict Tenant due to the need for vacant possession to complete major renovations to the rental unit and the residential complex.
Landlord purchased the residential complex in 2020 and plans to gut and renovate each unit to ensure the complex retains its value and to provide habitable units. The renovations will take 6-9 months and include new insulation, drywall, windows, doors, flooring, lighting fixtures, paint, HVAC systems, kitchen cabinets, appliances, bathroom cabinets, plumbing, electrical wiring, and the addition of a second bedroom.
Landlord failed to disclose all previous N13 notices served in the last two years on the L2 application.
Landlord's application to evict is not made in good faith, as the renovations are not necessary and are being completed only for aesthetic reasons.
Tenant is willing to live in a construction zone for some time, but acknowledged she would not be able to live in the unit during the removal and installation of drywall, or live in the unit for prolonged periods without water or electricity.
