The tenancy is terminated effective February 5, 2024, unless the Tenant pays $23,673 by January 31, 2024 or $24,843 by February 5, 2024 to void the order. If the Tenant does not pay, they must move out by February 5, 2024 and pay $22,656.88 plus daily compensation of $38.47 from January 4, 2024 until move-out.
The Tenant is living in subsidized housing for seniors and has lived in the rental unit since 2020, so the adjudicator granted the Tenant some time to find alternative accommodations.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The Tenant stated that she wished to remain in the rental unit and proposed a payment plan that would take her approximately 109 months to make the Landlord whole, but declined to pay more each month to lessen the length of the payment plan.
