The Landlord's application is granted. The tenancy is terminated effective February 14, 2025. If the unit is not vacated by that date, the Landlord may file the order with the Sheriff for enforcement starting February 15, 2025. The Board considered the Tenant's age and long-term tenancy, but found it would not be unfair to delay the eviction to give the Tenant time to explore options and engage services to assist with relocation.
Tenant's age and long-term tenancy
Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant's failure to prepare the rental unit for pest treatment and keep the unit in a reasonable state of cleanliness, which substantially interfered with the reasonable enjoyment and lawful rights of the Landlord and other tenants, and impaired the safety of persons in the residential complex.
Landlord tried to refer the Tenant to Toronto Public Health and other service providers to help the Tenant clean and prepare the rental unit for pest control, but the Tenant refused to use any of these services.
Tenant refused to allow anyone into the rental unit to help clean it on May 17, 2024.
