Tenants' motion to set aside the eviction order is denied. The stay of the eviction order is lifted immediately.
Landlords applied for an order to terminate the tenancy and evict Tenants and for an order to have the Tenants pay the rent they owe because the Tenants did not meet a condition specified in the order issued by the LTB on July 23, 2024.
Landlords waited several months before serving N4 notice, negotiated in good faith with Tenants, but Tenants breached the agreement almost immediately and failed to make any payments since July 2024.
Tenants failed to pay rent and arrears as per the previous order.
