The Landlord's application to terminate the tenancy and evict the Tenants is granted. The tenancy will be terminated on June 30, 2024 if the Landlord pays the Tenant $2,000 in compensation by April 5, 2024. If the Landlord does not make the required payment, the tenancy will not be terminated. The Landlord owes the Tenant $2,390.33 for the rent deposit and interest, which exceeds the amount the Tenant owes the Landlord.
Considering the length of the tenancy and the age and health of the occupants, a brief delay until June 30, 2024 will not unduly prejudice the Landlord.
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by their child.
Tenant's 84-year-old mother resides in the rental unit. Tenant is aware rents have increased significantly and due to health issues, he is unable to live in basement and apartments.
