Tenant applied for an order determining that the Landlord entered the rental unit illegally, substantially interfered with the reasonable enjoyment of the rental unit or residential complex, and harassed, obstructed, coerced, threatened or interfered with the Tenant.
Landlord submitted that they received numerous complaints from other Tenants regarding the Tenant and his guest's behaviour, such as stealing food and leaving a mess in the kitchen. Landlord also submitted that they felt harassed and under stress because of these complaints and sought therapy to help deal with the stress.
Tenant received N7 notice on November 7, 2022 for inviting his friend 'Miles' who is not allowed to come to the house because of a police order, and for using other people's things and smoking. Tenant states these allegations were not true.
The Landlord must pay the Tenant $2,285.00 by May 14, 2024 for substantially interfering with the Tenant's reasonable enjoyment and harassing the Tenant. The tenancy is terminated as of December 31, 2022.
