The Tenants' application is dismissed. The Tenants did not prove on a balance of probabilities that the person referred to in the Landlords' N12 notice did not move into the rental unit within a reasonable time after the Tenants vacated.
Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith. The Landlords served the Tenants with an N12 notice to terminate the tenancy for personal use.
Tenants testified that they vacated the rental unit on July 31, 2023 due to the N12 notice served by the Landlords. They also testified about their observations of the rental unit after they vacated.
