Unless the Tenants void the order by paying $10,209 by September 30, 2024, the tenancy will be terminated. If the Tenants do not void the order, they must pay the Landlord $6,290.82, which includes rent arrears and the application filing fee, minus the rent deposit and interest on the deposit. The Tenants are also ordered to pay daily compensation of $55.59 for each day of occupation starting August 22, 2024 until they vacate the unit.

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Landlord sought 'standard' eviction order based on substantial rent arrears with no payments made since application filed.
Landlord attempted to communicate with Tenants regarding repayment plan in July 2024 and every month up until hearing, but received no response.
Tenants want to preserve tenancy and avoid eviction. Proposed 24-36 month repayment plan to make Landlord whole.
