The Landlord shall pay the Tenants $2,548.00, which represents a rent abatement of $2,500.00 for the period ending April 4, 2022 and the $48.00 application filing fee. The Landlord must pay the full amount by September 15, 2024, after which interest will accrue at 7% annually on the outstanding balance.
Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards due to ongoing plumbing and septic issues in the rental unit.
Landlord acknowledged being advised of the issues 16 times via text messages, but claimed they did their best to address the problem, including pumping the septic system 3 times per year.
Tenants advised Landlord of septic backup and plumbing issues on multiple occasions from June 2021 to March 2022, but issues were not resolved.
