Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The Tenant failed to comply with the Interim Orders to pay the ongoing rent, so the Tenant was not permitted to raise their section 82 issues regarding disrepair. The Landlord's evidence showed the rent increases were valid, so the N4 Notice was also valid. The Tenant's proposed payment plan was not accepted as the arrears were substantial and the Tenant provided no evidence to substantiate their anticipated income.
