The tenancy will be terminated on May 20, 2023 unless the Tenant pays $13,450.49 to void the order and continue the tenancy. If the Tenant does not pay the full amount, the Tenant must move out by May 20, 2023 and pay $9,276.09 to the Landlord.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord's agent stated the Landlord has tried to reach out to the Tenant for a repayment plan, without success.
Tenant acknowledged the substantial arrears owing, noting he has had other financial commitments which have led to the arrears. The Tenant lives alone and advised he has had health issues and sporadic employment.
