The tenancy is terminated unless the Tenant pays $15,486 by January 31, 2024 or $17,886 by February 29, 2024 to void the order. If the Tenant does not void the order, they must vacate the unit by February 29, 2024 and pay the Landlord $9,647.84 plus daily compensation of $78.90 from December 19, 2023 until the date they move out.
Tenant's difficult circumstances involving health issues and Landlord holding last month's rent deposit
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Tenant requested the Board exercise its discretion to allow them to remain in possession of the unit.
Tenant (RB) testified that she is currently not working and has applied for ODSP, but has not been approved yet. Tenant also testified that her husband is off work and will be returning to work in the new year, and that they will be receiving large settlement payments in February and March 2024.
