The tenancy is terminated unless the tenant pays $14,264.88 to the landlord or the LTB in trust by May 15, 2023. If the tenant does not pay the full amount, they must move out by May 15, 2023, and the landlord may file the order with the Sheriff for enforcement. The tenant is also ordered to pay the landlord $12,166.16 in rent arrears and application costs, and $29.18 per day for use of the unit from April 21, 2023 until the tenant moves out.
The landlord applied for an order to terminate the tenancy and evict the tenant due to non-payment of rent. The order was issued on March 16, 2023, and the tenant requested a review of the order and a stay of the order until the review was resolved. The review hearing was held on April 20, 2023, and the parties consented to the order.
Tenant alleged they were not reasonably able to participate in the proceedings and that the order contained a serious error.
