The Tenants' application is dismissed. The Landlord provided sufficient evidence to show that he moved into the rental unit within a reasonable time after the Tenants vacated.
Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenants with an N12 notice to terminate the tenancy for personal use.
Landlord testified that he moved into the rental unit on February 20, 2020, and was assisted by two witnesses. Landlord also completed renovations and repairs to the unit.
Tenants testified that they attended the rental unit on several occasions and never saw the Landlord or his vehicle, and the unit looked unoccupied.
