The tenancy will be terminated on October 31, 2023 unless the tenants pay $13,649 by September 30, 2023 or $15,150 by October 31, 2023 to void the order. If the tenants do not pay, they must move out by October 31, 2023 and pay the landlord $9,686.96 plus daily compensation of $49.35 from July 18, 2023 until they move out.
The tenants have attempted to make good faith payments towards the rent for a few months since the tenant started working, and they need more time to find another place to live.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
The landlord was unwilling to grant the tenant's proposed 3-year payment plan for the arrears.
Landlord's agent S. Dixon said the tenants made some late rent payments from February to May 2023, but made no payments in June or July 2023.
Tenant M. Mcbean proposed a payment plan to pay $300 per month towards the arrears as well as the monthly rent.
Tenant M. Mcbean said she paid the July rent on July 14, 2023, three days before the hearing, because of her pay schedule. She said she has a new job since February 2023 and has been paying rent since then, but her son who lives with her does not contribute to the rent.
