The tenancy is terminated unless the Tenant pays $10,756.13 by April 30, 2023 or $12,312.09 by May 31, 2023 to void the order. If the Tenant does not void the order, the Tenant must move out by May 31, 2023 and pay the Landlord $8,237.52, which includes rent arrears and the application filing fee, minus the rent deposit and interest.
To allow the Tenant to either repay the arrears in full or find a new unit
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Rejected Tenant's payment plan as Tenant's employment does not seem secure enough to support the plan, and Tenant has only made two payments since the application was filed.
Tenant acknowledged the arrears and offered a payment plan to pay regular rent plus $600 per month until arrears are repaid.
