The tenancy is terminated effective January 31, 2025. The Tenant must move out by this date. If the unit is not vacated by this date, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant shall also pay the Landlord compensation of $76.93 per day for the use of the unit starting September 25, 2024 until the Tenant moves out.
The prejudice to the Tenant outweighs the prejudice to the Landlords. The Tenant's family has formed community bonds and is struggling financially, while the Landlords are not at risk of homelessness.
Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords in good faith require possession of the rental unit for the purpose of residential occupation for at least one year.
Landlords testified that the rental unit is ideal for their retirement years and that their current basement apartment is not ideal for their health and age.
Tenant believes the Landlords' true intention was always to sell the home and obtain vacant possession for renovations.
Tenant testified that he and his family have lived in the rental unit for 5 years and have formed bonds within the community. Tenant's wife recently lost her job and the family is struggling with significant debt.
