The Landlord proved the grounds for termination, but the LTB granted relief from eviction to the Tenant subject to conditions. The Tenant must pay the $186 application fee by November 11, 2024 and comply with conditions for 12 months, including not entering the convenience store or the building it is located in, and not seriously impairing the safety of others or committing illegal acts in the residential complex.
The incident was a serious but momentary lapse in judgment by the tenant, and there was no evidence of similar behavior before or since. The landlord's main concern was with other family members who do not live in the rental unit.
Landlord applied to terminate the tenancy and evict the tenants due to the tenant committing an illegal act and seriously impairing the safety of another person in the residential complex. The tenant threw store merchandise and a hand sanitizer bottle at a convenience store employee, damaging property.
Even though this was a singular incident, it is sufficient to affect the character of the residential complex and warrants a termination of the tenancy.
This was an isolated incident, a mistake that will not be repeated. The tenant has not been subject to eviction notices previously or since, and no evidence of similar incidents was presented.
Tenant Juan Pablo Baquero entered a convenience store located on the residential complex, got into an argument, and violently threw store merchandise and a hand sanitizer bottle towards a staff member, damaging property.
