The tenancy is terminated effective December 15, 2024. The Tenant must pay the Landlord $6,343.26, which includes rent arrears, application filing fee, and unpaid utilities. If the Tenant does not pay the full amount by December 15, 2024, the Landlord may file the order with the Court Enforcement Office for eviction.
Considering all the circumstances, the tenancy is not viable and the Tenant has not presented a reasonable plan to pay rent and arrears.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The Landlord also claimed compensation for unpaid utilities.
Landlord submitted that because the Board by interim order LTB-L-096573-23 ordered the Tenant's property to be preserved and prohibited the Landlord from re-renting the rental unit, the Tenant should pay rent for that period.
Tenant argued she should not owe rent from February 12 to March 19, 2024 when she was evicted due to an ex parte order.
Tenant testified she didn't pay rent in January and July, and paid partial rent in February. She didn't pay utilities for over 2 years.
