The Landlord's application is granted, subject to the Tenant making the following payments: $8,000 by October 28, 2024 and the remaining $6,236 by December 31, 2024. The Tenant must also pay new rent on time and in full until the arrears are paid. If the Tenant fails to make any of the payments, the Landlord may apply to the LTB to terminate the tenancy and evict the Tenant.
Tenant able to pay $8,000 immediately and remainder by end of year
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord submitted that an extended order to November 30, 2024 to give the Tenant additional time to pay the arrears would be appropriate.
Tenant proposed a repayment plan to pay $8,000 by October 28, 2024 and then $300 per month towards arrears until balance is paid.
Tenant's hours were cut at work, leading to large drop in income and causing them to fall into rent arrears. Tenant has now received $8,000 from family and can pay that amount immediately.
