The tenancy is terminated as of March 5, 2024, when the original order was enforced. The Tenant is ordered to pay the Landlord $16,898.88, which includes rent arrears up to the termination date and the cost of filing the application, minus the rent deposit and interest on the deposit.
Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant requested a review of the original order, arguing that he was out of the country and did not receive the notice of hearing. The review was granted, and a new hearing was held to consider the merits of the original application.
Tenant argued that his tenancy should have terminated on March 31, 2023 or August 31, 2023 when his lease term ended.
Tenant left the rental unit on March 31, 2023 while traveling to India, but did not formally terminate the tenancy. Tenant's belongings remained in the unit until it was vacated on March 5, 2024.
