The Landlord's application to terminate the tenancy and evict the Tenant for non-payment of rent is granted. The Tenant may void the order by paying $14,777.65 by February 29, 2024 or $16,102.80 by March 31, 2024. If the Tenant does not void the order, the Tenant must vacate the unit by March 31, 2024 and pay the Landlord $13,173.03 plus daily compensation.
The Tenant is currently in treatment and is a single mom with two children. The Tenant has not made any payments since the application was filed, and the prejudice to the Landlord continues. However, eviction will be postponed until March 31, 2024 to allow the Tenant time to either void the order or vacate the unit.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The Tenant acknowledged the arrears and testified that she had reached out to the Landlord in May and June of 2023 as she had lost her job in April. The Tenant further testified that she has been before the Board prior with respect to this tenancy and had completed a payment plan back in 2021.
