Tenant applied for an order determining that Landlord substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of their household; and, failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006.
The onus rests with the Tenant to prove this claim on a balance of probabilities. The Tenant's evidence regarding the dislodged roof shingle(s) and purported injury was conflicting, making the Tenant's roofing allegation less believable. While the Tenant's application stated on "May 17th, my children, myself, and my mother in law were in the backyard and a sheet of shingle fell off the roof and hit my son" (emphasis added) at the hearing the Tenant testified she was not at the rental unit on May 17 when the incident occurred (emphasis added). Moreover, at the hearing KM stated her child fell onto a shingle after picking it up, thus contradicting the Tenant's application which provided for a different version of events. The Tenant did not produce any medical reports or other corroborating evidence in support the May 17 incident, nor did the Tenant produce her mother-in-law as a witness at the hearing, or any pictures of the roof/fallen shingles. There was insufficient evidence presented to determine on a balance of probabilities that the Landlord breached the Act as it pertains to the roof shingle allegation.
The Landlord Monica Jain (MJ) acknowledged being advised of the pigeons/roof concerns in April 2022 only and states she hired both a pest control company who attended at the property and removed a bird's nest, as well as a roofing company to fix a single, dislodged roof shingle. MJ states she was never advised of any further concerns with birds/roof after April 2022, nor was she ever advised that the Tenant's son had injured himself with a fallen roof shingle. The Landlord also produced text correspondence between the Landlord and Tenant from April 2022, in which the Landlord advised "For birds we hired other inspectors who inspected. If you remember they went on the roof physically. They mentioned there were no issues and nothing to remove".
Tenant Kasandra Mccaughley (KM) alleges there were pigeons in her attic and under the roof solar panels which were loud, dirty and caused roof shingles to fall off the roof. According to KM, the Landlord was advised on December 6, 2021 about this issue and a representative from a pest control company came on December 15, 2021. The Tenant states the Landlord subsequently sent a roofing contractor to the home who did not address the bird issues. The Tenant also alleges the kitchen sink continued to leak after January 20, 2022 and she was forced to use the downstairs sink to wash dishes as a result.
The Tenant's T6 application alleging the Landlord failed to meet maintenance obligations is granted in part. The Tenant is awarded a rent abatement of $750 for the pigeon/roof issue from January to March 2022, and $115 for the kitchen sink issue from January 5 to January 20, 2022, for a total of $913. The Tenant's other allegations are dismissed.
