Tenants applied for an order determining that the Landlord collected or retained money illegally by increasing the rent above the guideline amounts without a valid N10 agreement. The Landlord served N10 agreements on the Tenants, but the Tenants did not counter-sign them. The Landlord also served an N1 notice of rent increase, which the Tenants partially paid.
Landlord thought the N10 agreement was sufficient to raise the rent above the guideline amounts due to renovations, and that the Tenants had accepted the increase by paying it for 11 months.
