The landlord failed to comply with the Residential Tenancies Act requirements for rent increases, including providing proper notice and not exceeding the guideline. The former tenant is entitled to reimbursement of the illegal rent increase collected by the landlord.
The former tenant applied for an order reducing the rent increase because the landlord failed to comply with the terms of an agreement to increase the rent above the guideline. The application was amended to a T1 application to determine whether the landlord collected or retained money illegally.
Landlord tried to offer $195 to former tenant after they vacated, but former tenant did not respond.
Former tenant vacated the rental unit on April 25, 2024.
