Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord attempted to communicate with Tenant regarding a repayment plan in August 2024 and every month up until the hearing date, but received no response.
Tenant went to visit family in Quebec in February 2024 and authorized her grandson to pay rent, but he did not. Tenant is still out of province staying with family and does not have any financial obligations where she is currently staying.
