The Landlord was in breach of their maintenance duties with respect to a mold issue in the rental unit, but not with respect to snow removal and yard maintenance. The Landlord substantially interfered with the Tenant's reasonable enjoyment of the rental unit due to the lack of response to the mold issue. The Landlord must pay the Tenant $55.49 and an administrative fine of $2,000 to the LTB.
Tenant applied for an order determining that Landlord substantially interfered with the reasonable enjoyment of the rental unit or residential complex, withheld or interfered with their vital services, and failed to meet their maintenance obligations. The Landlord did not attend the hearing.
Landlord did not respond to Tenant's complaints about mold and maintenance issues for several months, and only had someone inspect the mold issue in April 2022 but did not complete any remediation.
Tenant had to remove discarded moldy drywall himself, had to purchase a space heater to thaw frozen pipes, and had to do snow removal and yard maintenance himself.
