The Board found that the Tenant became the lawful Tenant as of May 1, 2022 and the Landlord's actions in changing the locks on September 1, 2022 without providing replacement keys was a breach of the Residential Tenancies Act, 2006. The Board ordered the Landlord to pay the Tenant $500 for the reasonable costs of replacing property and $53 for the application fee.
Tenant applied for an order determining that the Landlord entered the rental unit illegally and altered the locking system on the door without providing replacement keys.
Landlord testified that she went into the unit and changed the locks as of September 1, 2022 as it was obvious that no one was living in the rental unit.
Tenant testified that she was locked out of her unit on September 1, 2022 and was never permitted back into the rental unit and was unable to get any of her belongings.
