Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit at the time of the hearing.
The tenant should have paid the rent arrears to void the N4 notice. The landlord was entitled to the rent arrears up to the hearing date, minus the rent deposit and interest on the deposit. The landlord was also entitled to the cost of filing the application.
Tenant informed the Board that his kids would begin working in June and would be able to help pay the arrears.
The tenancy will be terminated on August 27, 2023 unless the tenant pays $14,158.72 to void the order. If the tenant does not pay, they must move out by August 27, 2023 and pay the landlord $4,126.99, plus daily compensation of $54.91 per day starting March 29, 2023 until the move-out date.
