The former tenants shall pay the landlord $5,129.69, which includes rent and compensation owed until the end of the lease term, less the last month's rent deposit and interest. The landlord's claim for damages was dismissed as the landlord failed to prove the former tenants caused undue damage.
Landlord applied for an order requiring former tenants to pay rent arrears and compensation, as well as damages to the rental unit. The former tenants vacated the unit on January 28, 2023 but the landlord claimed rent was owed until the end of the lease term on April 30, 2023.
Landlord argued the tenancy was not lawfully terminated and the former tenants owed rent until the end of the lease.
Landlord requested former tenants return the keys and pay rent until the end of the lease term on April 30, 2023.
Tenants argued they provided proper notice to terminate the lease and should not be responsible for rent beyond their vacate date.
Tenants vacated the rental unit on January 28, 2023 and provided notice of their intent to terminate the lease early.
