Tenant's application is dismissed. Landlord did not breach maintenance obligations regarding balcony odor issues.
Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The issue was related to chemical odors from the balcony tiles.
Landlord investigated the issue, had their own expert assess the balcony, and found no detectible problem.
Tenant complained about chemical odor from balcony tiles, which was especially strong on hot, sunny days. Tenant had expert test the tiles and provide report.
