The Landlord's application to terminate the tenancy and evict the Tenants is granted. The tenancy is terminated effective August 31, 2024. The Tenants must vacate the rental unit by that date. The Tenant must pay the Landlord $1,413 for unpaid utility costs, and the Landlord owes the Tenant $2,881.32 for the rent deposit and interest. The Landlord is ordered to pay the Tenant the equivalent of one month's rent as compensation by July 31, 2024.
Tenant's mental health issues and difficulty packing/moving
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.
Landlord and their child Gajan Ramachandran intend to move into the rental unit once it is vacated. They are currently living with the Landlord's son-in-law, daughter and 2 grandchildren in a crowded 4-bedroom home, causing strife between family members.
Tenant requests postponement of eviction to December 31, 2024 or as long as possible due to Ritu Dosaj's mental health issues and difficulty packing/moving.
Tenant Ritu Dosaj is experiencing serious mental health issues and requires a great deal of care and attention from her family. The thought of moving is very stressful for her.
