The Landlords' application to terminate the tenancy and evict the Tenant for non-payment of rent is granted. The Tenant may void the order by paying $17,198.50 by February 28, 2025 or $18,531 by March 31, 2025. If the Tenant does not void the order, the tenancy is terminated and the Tenant must vacate by March 31, 2025. The Tenant shall pay the Landlord $14,153.51 in rent arrears and application fees.
The Tenant is a single mother on assistance with a 5-year-old child and a dog, and requested 60 days to collect their belongings.
The Landlords applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlords served a valid N4 Notice and the Tenant did not void the notice by paying the arrears.
Tenant testified that due to maintenance issues, they paid to stay elsewhere and haven't been able to live in the rental unit. Tenant also testified that they became unsure of who to pay rent to after the Landlord Frank Hermann passed away.
