The Tenant's T2 application is dismissed as the Tenant did not prove the allegations on a balance of probabilities. The Landlord's A2 applications are dismissed as moot.
The Tenant applied for an order determining that the Landlord entered the rental unit illegally, altered the locking system without providing replacement keys, substantially interfered with the Tenant's reasonable enjoyment, and harassed the Tenant. The Landlord applied for an order to terminate the tenancy and evict unauthorized occupants due to the Tenant transferring occupancy without consent.
Landlord attended the unit on November 25, 2023 to collect keys from the occupant who was vacating the unit.
Tenant moved to China in 2020 and rented out the unit to unauthorized occupants without landlord's consent.
