The Landlord's application to terminate the tenancy and evict the Tenant is granted. The tenancy is terminated effective October 31, 2024. If the Tenant does not vacate by that date, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant is ordered to pay the Landlord compensation of $55.60 per day for use of the unit starting June 13, 2024 until the Tenant moves out. The Landlord owes the Tenant $1,750.38 for the rent deposit and interest, which the Landlord may deduct from the compensation owed by the Tenant.
To allow the Tenant time to change his address for his immigration application
Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlord, Mohamad Hamieh, requires possession of the rental unit for the purpose of residential occupation for at least one year.
Tenant argued landlord's actions suggest bad faith in seeking possession.
Tenant testified about landlord's attempts to increase rent above guideline and shortly after last increase.
