The Landlord's application was granted. The tenancy is terminated and the Tenant must vacate the rental unit by December 15, 2024. If the Tenant does not vacate by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction.
The Tenant has resided in the rental unit for approximately 3 years and resides in the unit with her four children. The Tenant is also on a fixed income (ODSP) and has currently experienced some health concerns throughout the last year.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant gave notice to terminate the tenancy. The Tenant initially gave 60 days' notice to vacate the rental unit on April 9, 2024 due to maintenance concerns, and the parties later agreed to extend the termination date to June 30, 2024.
The Tenant stated that in both the text message and email her daughter in law misinterpreted the Tenant's intentions. The Tenant stated that she meant to only advise the Landlord that she would be vacating if the Landlord did not address her maintenance concerns.
