Unless the Tenant voids the order by paying $12,889.34 by 2024-08-31 or $15,661.96 by 2024-09-10, the tenancy will be terminated. If the Tenant does not void the order, they must pay the Landlord $8,668.05 and vacate the unit by 2024-09-10. The Tenant may also make a motion to void the order if they pay the full amount owing plus any additional rent by the time the Sheriff enforces the eviction.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Tenant was not employed as of the hearing date, but anticipated starting a job as a school bus driver in September 2024. However, the anticipated income would not be sufficient to cover new rent or a meaningful payment plan.
