The tenancy will be terminated on December 31, 2024 unless the Tenants void the order by paying $18,386 by November 30, 2024 or $21,486 by December 31, 2024. If the Tenants do not void the order, they must move out by December 31, 2024 and pay the Landlords $13,373.16 plus daily compensation of $101.92 from November 14, 2024 until they move out.
To allow Tenants time to find alternative accommodation and for their children to finish the school term
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenants did not void by paying the arrears. The Tenants were still in possession of the rental unit at the time of the hearing.
Landlords testified that this is not a mortgage-free property and they have missed at least 3 mortgage payments and needed to sell their principal residence to prevent losing this property.
Landlords are in debt $40,000 and homeless due to Tenants' non-payment of rent
Tenants testified that the arrears were due to inconsistencies with their employment, but are now working full-time and proposed a repayment plan.
Tenants have not made any payments since the application was filed despite receiving government assistance
