Landlord open to repayment plan, no circumstances warranting denial of eviction
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenants did not void by paying the arrears. The Tenants were not present at the hearing, but the Landlord believed they were still in possession of the rental unit.
Landlord Dustin Farkas testified that at the time of filing the application he believed both Tenants were still in possession, but as of the hearing date he believes there is a small possibility Tenant Dylan Staley may have vacated at some point.
